Supreme Court Hears Arguments in Challenge to Tennessee Ban on Gender Transition Procedures for Minors

Yesterday, the U.S. Supreme Court heard oral arguments in United States v. Skrmetti, a case involving a legal challenge to Tennessee’s law banning gender transition procedures for minors. The Court’s decision will determine whether children across America can be protected from ideologically driven treatments and surgeries to alter or mutilate their bodies, or whether states will be powerless to stop gender experimentation on minors. 

Massachusetts has been one of the epicenters of so-called “gender-affirming care” for minors. This euphemism conceals the reality of these heinous procedures, which involve irreversibly altering the hormones of young children, chemically castrating boys, inducing early menopause in girls, and carving off healthy body parts. Boston Children’s Hospital is a prominent provider of pediatric “gender-affirming care” and offers all of these services. In addition, MFI uncovered last year that the Commonwealth of Massachusetts spent over $7.6 million of taxpayer money from 2012 to 2022 on gender transition treatments for minors alone. 

At least 21 states, including Tennessee, have recently taken action to protect children by banning these barbaric practices. In response, the Biden administration sued them, alleging that they had violated the equal protection rights of transgender children. Now, the Supreme Court must decide whether to embrace the radical idea that children can be born in the wrong body, or to reject gender ideology and allow states to safeguard the health of minors. Thankfully, the Court’s conservative majority appeared skeptical of the argument that they should strike down Tennessee’s law. However, we will not know for sure how the Court has ruled until their decision is released in the coming months. 

While the outcome of U.S. v. Skrmetti won’t make any immediate changes in Massachusetts, a positive ruling which upholds Tennessee’s ban on gender transition procedures would pave the way for the incoming Trump administration to take action at the federal level. President Trump has pledged to strip Medicare and Medicaid funding for any hospital that performs such procedures on minors. This would be a massive blow to the trans-industrial complex in Massachusetts, including Boston Children’s Hospital and Planned Parenthood
